This Policy explains how Arbitrator Intelligence (“Arbitrator Intelligence”, “we”, “us”, or “our”) processes the information that it collects about arbitrators. This Policy applies to all information about arbitrators collected through our website https://arbitratorintelligence.com, when a user (“Responder”) completed feedback survey online or by telephone and/or any related activities.

How do we process information about arbitrators collected using our feedback survey? 

When a Responder provides feedback, they provide information about the performance of arbitrators in a specific arbitration. This information is collected and processed by Arbitrator Intelligence and used to produce Reports about arbitrators. Reports are sold on our Website. 

We collect and process personal data about arbitrators collected using our feedback survey, completed by parties to an arbitration, their counsel or third party funders, on the basis of Article 6(1)(f) GDPR, namely our legitimate interests in operating a platform with information about arbitrators and serving the international arbitration community, and the legitimate interests of the international arbitration community in having access to information about arbitrators. 

We therefore undertake to protect the rights and legitimate interests of our data subjects by publishing this Privacy Policy indicating how Arbitrator Intelligence processes the data collected via our feedback survey and by providing notice to each arbitrator about whom we receive data in accordance with Articles 14 and 21 GDPR.

Purposes and Legal Basis for the Processing

Arbitrator Intelligence processes personal data about individual arbitrators to enable it to pursue its legitimate business objective of offering products and services for sale to the arbitration community. Being able to receive such products and services is also a legitimate interest of the arbitration community. Such products include but are not limited to Reports about arbitrators. 

The legal basis is Article 6(1)(f) GDPR (processing of personal data necessary for the purposes of pursuing the legitimate interests of the Data Controller). 

Categories of Personal Data Concerned

Personal data processed by Arbitrator Intelligence includes:

(i)             Feedback related to your professional performance as an arbitrator. This includes all of the categories of information collected in our feedback survey;

(ii)            Data in the public domain (e.g. personal data about arbitrators available via publicly available awards, their professional websites, social media profiles).

Categories of Recipients of Personal Data

Personal data may be received by:

(i)             Members of the arbitration community who wish to purchase our products and services;

(ii)            Qualtrics, Arbitrator Intelligence’s data processor for the information collected via our feedback survey;

(iii)           Arbitrator Intelligence Inc and its employees, consultants and agents.

International Transfers of Personal Data

Arbitrator Intelligence is a company based in the United States of America. We sell our Reports worldwide. 

The legal basis for transfers to recipients outside the European Union are standard data protection clauses, Article 46 GDPR. Please contact us for further details, including the means to obtain a copy of them or where they have been made available. 

Period for which Personal Data will be Stored

Personal data will be stored by Arbitrator Intelligence for as long as it is necessary for the purposes set out above, unless a longer retention period is required by law (such as tax, accounting or other legal requirements). 

Originating Source of the Personal Data

Personal data originates from:

(i)            Feedback surveys completed by parties, counsel and third-party funders engaged in arbitral proceedings, online or orally; and

(ii)            The public domain (e.g. personal data about arbitrators available via publicly available awards, their professional websites, social media profiles).
